TERMS OF USE FOR CYBOZU, INC. EVALUATION SITE

1. Purpose of use
   1. You are permitted to use the product available for review on this site, while this site is provided by Cybozu, Inc. (hereinafter "Cybozu"), on a trial basis without charge under the terms described in this Terms of Use, exclusively for the purpose of consideration of introduction of Cybozu’s products.
   2. You are permitted to use and edit sample forms and sample data registered on this site and create and register new forms and data on this site. However, you are only permitted to delete forms and data that you yourself have created and registered on this site. Forms and data that you have registered on this site may be deleted by Cybozu at any time, at its sole discretion.
2. ID and password for the evaluation site
   

   You are permitted the trial use of the shared ID and password issued by Cybozu to all users for using the trial product on this site (hereinafter "ID for evaluation site"), only to run the trial product within the scope of the purpose described in the preceding section. In no event should the ID for evaluation site be used for the purpose of your own business or any other purposes other than those described in the preceding section.

3. Prohibited activities

   You are required to refrain from the following activities in using this site.

   1. Any act that is offensive to public order and morals (anti-social activities and activities promoting such activities)
   2. Any criminal act or any act that aids or suggests execution of such criminal acts
   3. Any act that may infringe upon intellectual property rights of Cybozu, other customers or third parties
   4. Any act that may harm or damage property, credit or reputation of Cybozu, other customers or third parties and any act that may infringe upon privacy rights, portrait rights or other similar rights of the same
   5. Any act that is in conflict with laws, regulations or treaties, regardless of whether such act is committed intentionally or negligently
   6. Any act that may give economic or mental disadvantage to Cybozu, other customers or third parties.
   7. Any insulting, slanderous or abusive act against Cybozu, other customers or third parties
   8. Pre-election campaign, election campaign or any act similar thereto, and any act in violation of Public Officers Election Act
   9. Advertisement of business of your own or of a third party, or any other act for commercial purposes, excluding those separately permitted by Cybozu
   10. Any act that is deemed to have adverse influence on minors
   11. Any act that is deemed to be a social activity relating to sex morals, religions or politics
   12. Any act that is deemed by Cybozu to interfere or be likely to interfere with the operation of this service or any other services provided by Cybozu
   13. Any act that harms or is likely to harm credit or reputation of this service or any other services provided by Cybozu
   14. Any act in breach of these Terms
   15. Collection and accumulation of personal information
   16. Any other acts that are deemed inappropriate by Cybozu
4. LIMITATION OF WARRANTY
   1. YOU CANNOT REGISTER ON THIS SITE ANY INFORMATION THAT IS LIKELY TO CAUSE ANY PROBLEM IF LEAKED, DAMAGED OR LOST. CYBOZU DOES NOT WARRANT AGAINST DAMAGES ARISING FROM ANY LEAKAGE OR DAMAGE OF ENTIRE OR PARTIAL DATA REGISTERED BY YOU ON THIS SITE WHILE YOU ARE USING THIS SITE. EVEN IF YOU OR A THIRD PARTY SUSTAINS DAMAGES ARISING FROM DAMAGE TO DATA, CYBOZU DOES NOT ASSUME ANY RESPONSIBILITY FOR SUCH DAMAGES SUSTAINED BY YOU OR SUCH THIRD PARTY.
   2. EVEN IF YOU OR A THIRD PARTY SUSTAINS DAMAGES, SUCH AS VIRUS INFECTION AND HACKING DAMAGE, THROUGH ACCESS TO THIS SITE, CYBOZU DOES NOT ASSUME ANY RESPONSIBILITY FOR SUCH DAMAGES SUSTAINED BY YOU OR SUCH THIRD PARTY.
   3. CYBOZU DOES NOT WARRANT THAT THE FUNCTIONS CONTAINED IN THE TRIAL PRODUCT AVAILABLE ON THIS SITE WILL SATISFY YOUR DEMAND, OPERATE PROPERLY, ARE FREE OF DEFECT (INCLUDING BUGS AND STRUCTURAL ISSUES) OR TO REPAIR SUCH DEFECTS IF SUCH DEFECTS ARE PRESENT. IN ADDITION, CYBOZU DOES NOT WARRANT THAT THE TRIAL PRODUCT AVAILABLE ON THIS SITE HAS THE SAME FUNCTIONS AS THOSE CONTAINED IN THE PRODUCT FOR SALE.
   4. CYBOZU SHALL NOT PROVIDE ANY WARRANTY OF DEFECTS OR ERRORS OF THE SharePoint BECAUSE THE SERVICE IS OPERATED ON THE Microsoft Office SharePoint Server 2010.(HEREINAFTER "SharePoint")
5. Suspension and stoppage of services
   1. Services provided through this site may be suspended or stopped for emergency if any of the following events occurs. As a general rule, Cybozu will not accept any request from you or a third party to stop our services for emergency. Even if you or a third party sustains damages due to suspension or non-suspension of services provided by Cybozu on this site, Cybozu does not assume any responsibility for such damages sustained by you or such third party.
      1. If such suspension or non-suspension is unavoidable for maintenance of the service system or maintenance or installation of telecommunication equipment necessary for the provision of services, or if any unavoidable trouble occurs to such system or equipment
      2. If Cybozu deems that provision of normal services is difficult due to significant burden or trouble to the service system
      3. If Cybozu learns a possibility of significant damages to you or a third party if it continues to provide services
      4. If provision of services becomes difficult due to stoppage or suspension of provision of telecommunication services by domestic telecommunications carriers or telecommunication business operators overseas
      5. If natural disaster, war, civil war, establishment/amendment/abolishment of laws and regulations or any other emergency occurs or is likely to occur
      6. If Cybozu considers it necessary to suspend or stop for emergency the provision of services.
   2. Cybozu reserves the right to change and partially terminate contents of services provided on this site for its own reasons, regardless of whether you are aware of it.
   3. Cybozu reserves the right to terminate the entire or partial services provided on this site for its own reasons.
6. Monitoring and deletion of information
   1. Cybozu may monitor data registered by you for the secure operation of this site.
   2. Cybozu may initialize or delete data registered by you on a regular basis, for the operation of this site.
   3. Notwithstanding the preceding section, if Cybozu considers deletion of such data necessary, Cybozu may delete the entire or partial data you have stored on Cybozu's server without giving you advance notice.
   4. Cybozu does not assume any responsibility for damages sustained by you arising from deletion or non-deletion of data.
7. Suspension of use

   When Cybozu considers that your use of this site is not appropriate, you are required to immediately stop using the trial product on this site.

8. LIMITATION OF LIABILITY

   YOU MUST ASSUME ALL LIABILITIES AND RISKS RELATING TO THE USE OF THE TRIAL PRODUCT ON THIS SITE, AND CYBOZU DOES NOT ASSUME ANY LIABILITY WHATSOEVER.

9. Governing Law and miscellaneous provisions

   These Terms shall be governed by and under the laws of Japan as to all matters including validity, construction and performance. Any dispute or claim arising out of related to These Terms shall be resolved by arbitration in Tokyo, Japan in accordance with the Commercial Arbitration rules of Japan Commercial Arbitration Association.

10. Miscellaneous

    These Terms of Use are the sole agreement between Cybozu and you concerning the license to use the trial product, and may be amended only by a written instrument bearing signatures or names and seals of both parties.
